Land title, mortgages, condition, charges: the checklist of verifications before signing.
The essentials in questions
How to check that a property has no mortgage?
Request a recent certificate of ownership from the Land Registry: it shows the real owner and any mortgages or objections recorded on the title.
What is a land title in Morocco?
It is the official document identifying a registered property and its owner. A titled property offers far greater legal security than an unregistered one (melkia).
Do you need a notary to check the property?
Yes, the notary (or adoul) checks the legal status, the absence of charges and the validity of documents before signing. It is essential protection.
1. Check the legal status
Require the land title and a recent certificate of ownership. Make sure the seller is indeed the owner and that the property is free of mortgage and objection.
2. Inspect the condition of the property
Check the state of the walls, plumbing, electricity and waterproofing. For an apartment, ask about co-ownership charges and works voted.
3. Check compliance
Check the occupancy permit and that the surfaces match the documents. An undeclared extension can cause problems on resale.
